MegaPari Rules and Regulations in Kenya
These Terms and Conditions govern your access to betting services in Kenya on the official website and mobile app. They apply to all users who register, place a bet, or use an account. By using the platform, you agree to comply with Kenyan legal requirements on gaming and taxation. MegaPari may update these Terms to reflect regulatory changes and operational needs.
General Terms
- Agreement and scope:
- By completing registration and using the services, you confirm that you have read and accept these Terms, the Privacy Policy, the Responsible Gambling policy, and any rules for promotions or a bonus. If you do not agree, you must stop use of the site and app.
- These Terms apply to all bets, games, and related services accessible in Kenya.
- Eligibility and user requirements:
- You must be at least 18 years old and legally allowed to gamble in Kenya.
- You must open only one account in your own name and for your own benefit, and you must not act for another person.
- You must be physically located in a place where betting is legal when placing any bet on an event.
- Changes to Terms:
- MegaPari (Afflinkers) may modify these Terms, betting rules, payout rules, and policies to reflect operational, security, or legal requirements. Updated Terms take effect once published. Continued use of your account confirms acceptance of changes.
- Proper use of the platform:
- You agree not to misuse the site, exploit any error, use bots or automated systems, interfere with odds or markets, or attempt unauthorised access.
- You agree not to post or transmit prohibited content, including content that is unlawful, abusive, or infringes third-party rights.
- Intellectual property and content protection:
- All software, trademarks, data, odds feeds, event information, and materials are protected by intellectual property laws. You may use them only for personal, non-commercial betting purposes and not reproduce, distribute, or scrape content.
- Limitation of liability:
- To the extent permitted by Kenyan law, the platform is provided on an “as available” basis. We are not liable for delays, interruptions, system errors, or failures of telecommunications that affect bet placement or settlement.
- We are not responsible for losses arising from your failure to safeguard login details, or for decisions you make about bets.
- Nothing limits liability for fraud or any liability that cannot be limited under Kenyan law.
- Governing law and dispute resolution:
- These Terms are governed by the laws of Kenya. Disputes may be handled by customer support first, then escalated to management or resolved through Kenyan courts or agreed alternative dispute resolution.
General Betting Rules
- Eligibility to place bets:
- You may place a bet only after successful registration, account verification where required, and once you have sufficient cleared funds.
- You must not place bets on behalf of others or as part of any syndicate designed to bypass limits.
- Bet acceptance and timing:
- A bet is accepted only when it is recorded on our servers and appears in your bet history. Pending or interrupted transactions are not considered accepted.
- Bets on an event may close at the advertised start time or earlier for market management. Bets placed after the official start time may be void unless offered as live betting.
- Minimum and maximum amounts:
- Minimum and maximum stake amounts and payout limits apply per market, sport, and selection. These limits may change based on risk controls.
- We may set account-level limits or restrict certain markets for responsible gambling or legal reasons.
- Odds, settlement, and calculation of wins/losses:
- Returns are calculated using the odds confirmed at acceptance and the stake shown in your bet slip.
- For accumulator bets, each selection must settle per market rules. A void selection in a multiple usually settles at odds of 1.00 and the rest continue.
- Official results from recognised governing bodies or data providers are used for settlement. Later corrections do not usually affect settlement unless specified in market rules.
- Palpable errors and obvious mistakes:
- If a market, price, handicap, total, or event information is posted in error, we may void the bet or settle at the correct odds at our discretion, acting fairly and in line with general industry practice.
- Suspensions, abandoned or postponed events:
- If an event is suspended, abandoned, or postponed, settlement follows the specific sport rules. A bet may stand, be delayed, or be void depending on whether the event is completed within the time set by market rules.
- Cash-out and cancellations:
- Cash-out may be offered for selected markets and is not guaranteed. If offered, the cash-out value is final when accepted and overrides normal settlement.
- Once accepted, a bet cannot be cancelled by you. We may cancel or void a bet where required by law, due to a technical issue, or where integrity concerns exist.
- Restrictions:
- We may limit the number of bets, restrict bonuses, cap payouts, or refuse a bet to manage risk, comply with legal requirements, or protect event integrity.
- Collusive betting, match fixing, or use of inside information is prohibited.
- Promotions and bonuses:
- Any bonus is subject to separate terms, including wagering requirements, market restrictions, and expiry. Where terms conflict, the promotional rules apply to that offer.
Payment Rules
- Funding your account:
- Accepted deposit methods may include M-Pesa, Airtel Money, bank transfer, cards, and other locally supported options. Available methods depend on your account status and location.
- Minimum and maximum deposit limits apply per method. Fees, if any, will be shown before you confirm a payment.
- Withdrawals:
- Withdrawals are paid to the same method used for deposit where possible. You may be asked to use a method in your own name only.
- Processing times vary by method and security checks. Standard timeframes may range from minutes to 72 hours after approval.
- KYC/AML verification:
- Before a withdrawal, you may be required to complete identity checks, including verification of ID, address, mobile number, payment instrument ownership, and source of funds.
- MegaPari (Afflinkers) may hold, reverse, or decline transactions that fail verification or breach Anti-Money Laundering controls.
- Transaction processing and security:
- Payments are processed once authorised on our systems and by the payment provider. Service interruptions may delay crediting or withdrawal.
- We may split, merge, or delay payouts to comply with security, risk, and legal obligations.
- Taxes and charges:
- As required by Kenyan tax law, applicable withholding tax may be deducted from winnings and remitted to the Kenya Revenue Authority. Excise or other statutory levies may also apply to stakes or payouts.
- Restrictions and cancellations:
- We may refuse or reverse a deposit or withdrawal if the payment was unauthorised, fraudulent, disputed, charged back, or linked to prohibited activity.
- You are responsible for entering accurate payment details. We are not liable for losses arising from incorrect information you provide.
Responsible Gambling
- Principles:
- Gambling should be recreational. You are advised to set limits, track your spend, and avoid chasing losses.
- Underage betting is prohibited. No person under 18 is allowed to hold an account or place bets.
- Player control tools:
- Deposit limits, stake limits, loss limits, and session reminders.
- Time-out and self-exclusion for defined periods, including indefinite exclusion on request.
- Access to your betting history to help you read and assess your behaviour.
- Self-assessment and support:
- A short risk self-assessment can help you evaluate your betting habits.
- Independent help is available through counselling professionals and support groups. Kenyan users can seek guidance from the National Authority for the Campaign Against Alcohol and Drug Abuse (NACADA) for counselling referrals, the Kenya Association of Professional Counsellors (KAPC), and international services such as Gamblers Anonymous and GamCare online resources.
- Implementation:
- Requests for limits or self-exclusion may require identity checks and apply across eligible services. Pending bets may still settle under market rules.
Anti-Money Laundering
- Legal obligations:
- The platform operates measures consistent with Kenya’s Proceeds of Crime and Anti-Money Laundering Act, the Prevention of Terrorism Act, and related guidelines from the Financial Reporting Centre.
- Know Your Customer (KYC):
- Verification may include government-issued ID, proof of address, proof of payment ownership, selfies or biometric checks, and source-of-funds or source-of-wealth evidence.
- Enhanced due diligence may apply to high-risk customers, large transactions, or Politically Exposed Persons.
- Monitoring and detection:
- MegaPari (Afflinkers) monitors transactions for unusual patterns, rapid deposit/withdraw cycles, third-party funding, or activity inconsistent with your profile.
- Screening may include sanctions and watchlist checks and ongoing review of account activity.
- Reporting and consequences:
- We may file reports with the Financial Reporting Centre where suspicious activity is detected and are not permitted to disclose such filings to you.
- We may delay, restrict, or block transactions, freeze funds, or close accounts that breach AML requirements or where we cannot complete verification.
